FAIRFIELD, Ohio -- The substitute teacher accused of performing a sex act inside a middle school classroom appeared in court Tuesday morning.

Tracey J. Abraham, 41, of Cincinnati, was arrested on Jan. 8 after he admitted to “fondling himself” in Creekside Middle School on Nilles Road while children were in the classroom, according to police. He appeared in Fairfield Municipal Court at 8:30 a.m. Tuesday with his attorney, Lou Sirkin.

Police charged Abraham with public indecency, a first-degree misdemeanor, after a school resource officer received complaints from several students and a staff member, according to a police report. He admitted to “fondling himself” on the outside of his pants as he was looking at explicit photos on his phone but was never exposed, according to the report.

A 13-year-old female student recorded Abraham’s behavior on her phone, which showed Abraham doing the act “while sitting behind the teacher’s desk at the front of the room and looking at his cell phone.”

Abraham appeared in court just a few hours after he was escorted from the classroom for an arraignment. The hearing was continued so he could obtain an attorney.

Abraham will appear in court on Feb. 6 for a pre-trial hearing. He is out on his own recognizance.
