Cincinnati city park board commissioner sues over appointment of replacement

CINCINNATI -- A city park commissioner is suing the city, claiming the mayor and council and unlawfully cutting her term on the park board short. 

The City Council voted this week to appoint James Goetz to the park board seat currently held by Dianne Rosenberg, but Rosenberg said in a lawsuit filed Friday that her term doesn't end until 2021. 

Rosenberg was appointed to the board in 2015. Park board terms last six years under the terms of the city charter, according to her lawsuit. However, some city officials have said that Rosenberg's term ends on Dec. 31, 2017 because she was filling the unexpired term of Cathy Crain.

The city website used to state that Rosenberg's term expired in 2021 but was recently changed to instead state it ends at the end of this year, according to her lawsuit. 

City officials did not immediately provide a comment on the case.

Rosenberg is asking a judge to void Goetz's appointment, declare that her term could not expire before Feb. 1 at the earliest and declare that all park board terms last six years.
