AMELIA, Ohio -- A Clermont County grand jury has indicted the two concealed carry weapons instructors involved in the shooting death of a Monroe Township gun shop owner on counts of homicide.

The grand jury returned an indictment Tuesday on CCW instructor Mark T. Montgomery on one count of reckless homicide, a felony of the third degree. His daughter, Katie Dunham (Montgomery), was assisting with the class and was indicted on one count of negligent homicide, a misdemeanor of the first degree.

Investigators and witnesses offered testimony from the fatal June 18 shooting of 64-year-old James Baker, owner of the KayJay Gun Shop located at 3023 Lindale-Mount Holly Rd. in Monroe Township.

The shooting occurred during a CCW class. Baker was shot and killed when a class participant discharged a handgun while practicing a weapon malfunction drill.

Eighteen witnesses testified at the grand jury proceeding including all 10 participants in the class. Other witnesses included investigators from the Clermont County Sheriff’s Office.
