NEWPORT, Ky. -- Shayna Hubers' new trial will begin early next year.
In court Tuesday, a Campbell County judge set the trial to begin Jan. 16, 2018 -- a four month delay from the original date, Sept. 18, 2017. Hubers' new out-of-state attorney had asked for a six-month delay in order to prepare.
Hubers is facing a murder charge in the death of her former boyfriend, Ryan Poston, who she admitted to shooting six times in his Highland Heights condominium in 2012, according to police.
She was previously found guilty in the case and sentenced to 40 years in prison, but defense attorneys later learned that one of the jurors was a convicted felon not qualified to serve on the jury. A judge decided that meant Hubers was entitled to a new trial.
Poston's father, Jay, released the following statement Tuesday:
"We as a family and a community have the serenity to accept that which we cannot change - the fact that Shayna Hubers has been granted a retrial for the cold-blooded murder of our beloved Ryan. Our families will not have true serenity, however, until we have been granted justice for Ryan. We are steadfastly resolved to pursue this as long as it takes to accomplish."
